License Types and Usage Rights

PERSONAL USE LICENSE - $10

Permitted Uses:

Personal prints up to 16x20 inches
Social media sharing with photographer attribution
Personal website or blog use (non-commercial)
Desktop wallpapers and personal digital use
Gifts for family and friends (non-commercial)

Restrictions:

No commercial use of any kind
No resale or redistribution
No use in business marketing or advertising
No merchandise creation for sale
Attribution preferred but not required: "Photo by Kevin Niedermeier - kevinniedermeier.com"

Duration: Perpetual for personal use only

COMMERCIAL BASIC LICENSE - $100

Permitted Uses:

Business websites and marketing materials
Print advertising (up to 10,000 copies total)
Social media marketing campaigns
Brochures, flyers, and promotional materials
Internal presentations and materials
Local/regional advertising campaigns

Restrictions:

Single company/organization use only
Cannot be resold or sublicensed
No merchandise creation for resale
No use in stock photo libraries

Attribution: Preferred but not required

Duration: 2 years from purchase date

COMMERCIAL EXTENDED LICENSE - $300

Permitted Uses:

Unlimited print runs and distribution
National and international advertising campaigns
Single company/organization use across multiple campaigns
Merchandise creation and resale rights (t-shirts, mugs, posters, etc.)

Restrictions:

Cannot claim ownership or copyright
Cannot be used for defamatory or illegal purposes
Photographer retains all original copyrights
No use in stock photo libraries

Attribution: Preferred but not required

Duration: 5 years from purchase date

General Terms and Conditions

Copyright and Ownership

Kevin Niedermeier retains full copyright ownership of all images
License grants usage rights only, not ownership transfer
All images remain property of Kevin Niedermeier Photography

Image Delivery

Digital images delivered via email or download link, usually within 48 hours but up to one week
High-resolution files provided without watermarks after payment
Images delivered in JPEG format unless otherwise requested

Model and Property Releases

Images are sold without model or property releases
Client is responsible for obtaining necessary releases for commercial use whenever required by applicable law
Photographer not liable for unauthorized use of recognizable people or property
Aviation and nature photos generally do not require additional releases

Prohibited Uses (All License Types)

Pornographic, defamatory, or illegal content
Hate speech or discriminatory materials
Misrepresentation of image content or context
Reverse engineering or attempting to recreate similar images

Payment and Refunds

Payment required before image delivery
Refunds available within 7 days if images not delivered as described
No refunds after image delivery

Liability and Warranties

Images provided "as is" without warranty
Photographer not liable for indirect or consequential damages
Maximum liability limited to purchase price paid

License Violations

Unauthorized use may result in legal action
Damages for violation may include attorney fees and statutory damages
License automatically terminates upon violation

Custom Licensing

Exclusive rights and custom usage terms available upon request
Contact photographer for bulk purchases or special requirements
Educational and non-profit discounts may be available
